Conceptul de «Lege» din cuprinsul art. 53 din Constituţia României

The concept of „law” in art. 53 of the Romanian Constitution is susceptible to several interpretations. The normative acts adopted by the Parliament as the sole legislative authority of the country represent laws stricto sensu, respecting both the formal and the material criterion of defi ning the concept of „law”, and the ordinances adopted by the Government, simple or emergency, represent laws lato sensu, respecting only the material criterion of defi ning the concept. The concept of „law” in art. 53 of the Romanian Constitution is not compatible with both the stricto sensu and lato sensu interpretations. An analysis of the relationship between freedom – autonomy and freedom – participation, as well as a teleological and systematic interpretation of art. 53 of the Romanian Constitution, highlights the compatibility of the concept of „law” in art. 53 of the Romanian Constitution only with the stricto sensu interpretation of the concept.

Conceptul de «lege» din cuprinsul art. 53 din Constituţia României este susceptibil de mai multe interpretări. Actele normative adoptate de Parlament ca unică autoritate legiuitoare a ţării reprezintă legi stricto sensu, acestea respectând atât criteriul formal, cât și criteriul material de defi nire a conceptului de «lege», iar ordonanţele adoptate de Guvern, simple sau de urgenţă, reprezintă legi lato sensu, acestea respectând doar criteriul material de defi nire a conceptului. Conceptul de «lege» din cuprinsul art. 53 din Constituţia României nu este compatibil atât cu interpretarea stricto sensu, cât și cu interpretarea lato sensu. O analiză a raportului dintre libertatea – autonomie și libertatea – participare, precum și interpretare teleologică și sistematică a art. 53 din Constituţia României, scot în evidenţă compatibilitatea conceptului de «lege» din cuprinsul art. 53 din Constituţia României doar cu interpretarea stricto sensu a conceptului.
