Evoluţia relaţiilor personale dintre copil și părintele separat în practica judecătorească

After the entry into force of the new Civil Code, which replaced the notion of visiting program, provided by the old legislation, with a new notion, namely that of maintaining personal ties, there was a change of mentality in the judicial practice in the sense that the right of the parent separated from the child to have a personal relationship with the child means something more or something else than a simple visiting program: it is about spending time with the child in any situation of his/her daily life and a stronger involvement in his/her life, especially in the context of the new technologies for remote communication.

Starting from the provisions of art. 18 of Law no. 272/2004, which details the way of exercising the right to a personal relationship with the child, the article shows the practical ways of interpreting the legal provisions in the judicial practice, clearly illustrating how to apply them.

După apariţia noului Cod civil, care a înlocuit noţiunea de program de vizită, prevăzută de vechea legislaţie cu o noţiune nouă, respectiv aceea de păstrare a legăturilor personale, în practica judecătorească a apărut o schimbare de mentalitate în sensul că dreptul părintelui separat de a copil de a avea legături personale cu copilul înseamnă ceva mai mult sau altceva decât un simplu program de vizită: este vorba de timp petrecut cu copilul în orice ipostază a vieţii sale cotidiene și de o implicare mai puternică în viaţa acestuia, mai ales în contextul noilor tehnologii de comunicare la distanţă.

Pornind de la prevederile art. 18 din Legea nr. 272/2004, care detaliază modul de exercitare a dreptului la relaţii personale cu copilul, articolul arată modalităţile practice de interpretare a dispoziţiilor legale în practica judecătorească, exemplificând, concret, modul de aplicare a acestora.
