Exercitarea dreptului de preempţiune la vânzarea terenurilor agricole, în dispoziţiile legilor speciale

The right of preemption in the sale of a good is, as a rule, regulated by law.

The main issue of theoretical and practical interest, which is limited to the institution of the right of preemption, is its exercise by its holders.

The exercise of the right of preemption in the sale of a good is regulated differently in the provisions of the Civil Code, compared to those contained in the special laws.

In the above context, the object of the study is exclusively the right of preemption to the sale of agricultural land located outside the built-up area, with special reference to its exercise mechanisms, contained in the provisions of special laws.

The analysis of the evolution of the preemption right, regulated in the special laws adopted after 1989, took into account the provisions of Law no. 18/1991, Law no. 54/1998, Law no. 17/2014 and Law no. 175/2020.

Dreptul de preempţiune la vânzarea unui bun este, de regulă, reglementat prin lege.

Principala problemă de interes teoretic și practic, ce se circumscrie instituţiei dreptului de preempţiune, este exercitarea acestuia de către titularii săi.

Exercitarea dreptului de preempţiune la vânzarea unui bun este reglementată diferit în dispoziţiile Codului civil, faţă de cele cuprinse în legile speciale.

În contextul de mai sus, obiectul studiului îl constituie exclusiv, dreptul de preempţiune la vânzarea terenurilor agricole situate în extravilan, cu trimitere specială la mecanismele sale de exercitare, cuprinse în dispoziţiile legilor speciale.

Analiza evoluţiei dreptului de preempţiune, reglementat în legile speciale adoptate după 1989, a avut în vedere dispoziţiile Legii nr. 18/1991, Legii nr. 54/1998, Legii nr. 17/2014 și Legii nr. 175/2020.
