Impactul inteligenței artificiale (AI) asupra drepturilor omului

Artificial intelligence and its effects on human society are the main topics of the moment, while challenging both IT and legal researchers. Humanity has reached a point where it must accept the role of artificial intelligence and assimilate it, adapting its value system, legal framework and economy to the new reality.

In April 2021, the European Commission announced its firm intention to develop and adopt legal measures and rules that will „turn Europe into the global hub for trustworthy Artificial Intelligence (AI)”. It is particularly important to highlight that guaranteeing the fundamental rights of citizens is a focal point in this whole regulatory process initiated by the European Commission in this relatively new field for our society. We mention „relatively new”, given the fact that the issue of artificial intelligence has appeared in the public space since the 50s, when viewers noticed the imminence of this unprecedented technological development in human history.

This article highlights the risks and opportunities posed by artificial intelligence in today’s society, identifies the rights and freedoms exposed to a high degree of risk posed by the lack of regulations in the field of AI systems and presents the solutions identified by European Commission on this regulatory crisis.

Inteligența artificială și efectele sale asupra societății umane reprezintă subiectele de interes ale momentului atât pentru cercetătorii în domeniul tehnologiei cât și pentru cercetătorii juriști. Omenirea a ajuns în punctul în care trebuie să accepte existența inteligenței artificiale și să o asimileze, adaptându-și sistemul de valori, sistemul juridic și sistemul economic la noua realitate.

În luna aprilie a acestui an, Comisia Europeană a făcut publică intenția fermă de a elabora și adopta măsuri și norme juridice care “să transforme Europa în polul mondial al inteligenței artificiale (IA) de încredere”[2]. Este deosebit de important să remarcăm faptul că garantarea drepturilor fundamentale ale cetățenilor reprezintă un punct focal în tot acest proces de reglementare inițiat de forul european în acest domeniu relativ nou pentru societatea noastră. Spunem „relativ nou”, deoarece problematica inteligenței artificiale a apărut în spațiul public încă din anii 50, când vizionarii au sesizat iminența acestei dezvoltări tehnologice fără precedent în istoria omenirii.

Acest articol evidențiază riscurile și oportunitățile generate de inteligența artificială în societatea actuală, identifică drepturile și libertățile expuse unui grad ridicat de risc generat de lipsa reglementărilor în domeniul sistemelor de AI și prezintă soluțiile identificate de forurile europene cu privire la această criză normativă.
