Respectul reciproc al soților. O încercare de sistematizare (Partea I)

Starting from the premise that Romanian legal scholarship has not exhaustively addressed the obligation of mutual respect between spouses, this article aims to examine the forms of such respect as they may be inferred from a negative reading of Law No. 217/2003. To the extent that this endeavor proves persuasive, the benefit of the analysis would be not merely theoretical, but also practical, insofar as it may offer interpretative guidance to the courts called upon to order the dissolution of marriage by divorce on the ground of the exclusive fault of one spouse.

Pornind de la premisa că doctrina juridică română nu a abordat în mod exhaustiv obligația de respect reciproc între soți, prezentul articol își propune să examineze formele acestui respect, așa cum pot fi ele deduse dintr‑o lectură negativă a Legii nr. 217/2003. În măsura în care acest demers se dovedește convingător, utilitatea analizei nu ar fi doar teoretică, ci și practică, în sensul că ar putea oferi instanțelor îndrumări interpretative atunci când sunt chemate să dispună desfacerea căsătoriei prin divorțpentru culpa exclusivă a unuia dintre soți.
