Tendinţele axiologice imprimate sistemelor constituţionale contemporane sub impulsul post-modernismului

Some of the more or less recent evolutions of the political philosophy can be interpreted as an attempt to overcome the modernity. According to them, the western countries that have been conceived as modern states should enter into a new phase of evolution, the postmodern one. This would suppose a new kind of state, the postmodern state, whose constitutional law would be different from that of a modern liberal state. The evolution is ongoing and it is not certain neither if it will be followed, neither if it is truly desirable, but what is certain is that some consequences on the way that the present western societies are constituted, have already occurred. The aim of the study is to outline the contours of the postmodern philosophies that have generated juridical effects in the present constitutional systems and to find the tendency that seems to be the most distinctive from the vision of a fair liberal society – reintroducing the values into the law.

Unele evoluţii, mai mult sau mai puţin recente, ale filosofiei politice pot fi interpretate ca o tentativă de depășire a modernităţii. Potrivit acestora, statele occidentale care au fost concepute ca state moderne ar trebui să intre într-o nouă fază de evoluţie, post-modernă. Aceasta ar presupune un nou tip de stat, statul post-modern, al cărui drept constituţional ar fi diferit de cel al statului liberal modern. Evoluţia este în curs și nu este cert nici că va fi urmată, nici că ea este cu adevărat dezirabilă, dar este sigur că unele consecinţe asupra modului constituirii societăţilor occidentale actuale s-au produs deja. Mă voi ocupa în acest studiu de schiţarea contururilor fi losofi ilor post-moderne care au produs efecte juridice în sistemele constituţionale actuale și de tendinţa care mi se pare cea mai distinctivă faţă de viziunea societăţii liberale juste – reintroducerea valorilor în drept.
