In this article, aspects related to the abusive exercise of the „right to access the Internet” are analyzed from the perspective of committing crimes that affect the mental freedom of the person. Thus, the offense of harassment is studied in the mitigating version, regulated by art. 208 paragraph. 2 C. pen., being brought to light a series of interesting aspects regarding the need to amend the criminal legislation in order to align the legal texts with the reality of the evolution of society in the context of the use of new technologies.

În prezentul articol sunt analizate aspecte referitoare la exercitarea abuzivă a „dreptului de acces la Internet” din perspectiva săvârșirii unor infracţiuni care aduc atingere libertăţii psihice a persoanei. Astfel, este studiată infracţiunea de hărţuire în varianta atenuantă, reglementată de art. 208 alin. (2) C. pen., fiind aduse în lumină o serie de aspecte de interes referitoare la necesitatea modifi cării legislaţiei penale în vederea alinierii textelor de lege realităţii evoluţiei societăţii în contextul folosirii noilor tehnologii.
