Aspecte privind infracţiunea de nerespectare a hotărârilor judecătorești. Impactul reconfigurării laturii obiective a infracţiunii de abuz în serviciu asupra valorilor sociale

The purpose of this paper is to analyze the crime of non-compliance with court decisions, on the one hand from the perspective of the requirements of the right to a fair trial that the suspect or defendant should benefit from, and on the other hand from the perspective of the legal consequences produced by the legislative construction represented by the provisions of art. 297 of the Criminal Code, as its objective side was reconfigured in terms of the material element.

In concreto, we will analyze the constitutive elements of the normative modalities contained in art. 287 of the Criminal Code, a study that occupies an overwhelming proportion of this paper, to then turn our attention to the legislative gap which appeared with the decision of the constitutional review court, to note that a priori to the constitutional review, if a civil servant did not comply with a court decision and with the provisions of art. 287 of the Criminal Code, regarding the crime of noncompliance with court decisions, this would have led to the analysis of the incidence of the provisions on the abuse of office, and currently the act of the civil servant remains unpunished – as long as it is not subsumed to the reconfiguration of the objective side of the crime of abuse of office under the material element aspect – and to conclude with a de lege ferenda proposal, in the sense of extending the crime regulated by art. 287 of the Criminal Code, by adding a new normative modality.

Last but not least, the paper includes, in addition to its own perspective in relation to various contradictory views expressed in the doctrine, practical applications of the articles of the Criminal Code, as they should be interpreted in terms of all legal rules in force.

Prezenta lucrare are ca obiective analizarea infracţiunii de nerespectare a hotărârilor judecătorești, pe de o parte din perspectiva exigenţelor pe care le presupune dreptul la un proces echitabil de care ar trebui să benefi cieze suspectul sau inculpatul, iar pe de altă parte din prisma consecinţelor juridice pe care le produce construcţia legislativă reprezentată de dispoziţiile art. 297 C. pen., astfel cum i-a fost reconfigurată latura obiectivă sub aspectul elementului material.

In concreto, vom analiza elementele constitutive ale modalităţilor normative cuprinse în art. 287 C. pen., studiu ce ocupă o proporţie covârșitoare din prezenta lucrare, ca mai apoi să ne îndreptăm atenţia spre vidul legislativ apărut odată cu decizia instanţei de control constituţional, să remarcăm faptul că a priori controlului de constituţionalitate, dacă un funcţionar public nu respecta o hotărâre judecătorească și nu se încadra pe dispoziţiile art. 287 C. pen., privind infracţiunea de nerespectare a hotărârilor judecătorești, s-ar fi analizat incidenţa dispoziţiilor privitoare la abuzul în serviciu, iar în prezent fapta funcţionarului public rămâne nepedepsită – cât timp nu se circumscrie reconfi gurării laturii obiective a infracţiunii de abuz în serviciu sub aspectul elementului material – și să încheiem cu o propunere de lege ferenda, în sensul extinderii infracţiunii reglementată de art. 287 C. pen., prin adăugarea unei noi modalităţi normative.

Nu în ultimul rând, lucrarea cuprinde, pe lângă perspectiva proprie prin raportare la diverse puncte de vedere contradictorii exprimate în doctrină, și aplicaţii practice ale articolelor din Codul penal, astfel cum trebuie acestea interpretate prin prisma ansamblului de norme juridice afl ate în vigoare.
