Este incompatibil judecătorul în cauzele în care una dintre părţi este reprezentată de avocatul e care îl reprezintă chiar pe judecător în alte cauze?

The article discusses the special case of a possible incompatibility of the judge in litigations where one of the parties is represented by the lawyer who represents the judge himself/herself in other cases. After analyzing the specific regulations as well as the national and European case law, the author considers that the representation of the judge in other cases by the lawyer of either party is not likely, by itself, to reasonably justify the fear of prejudice on the part of the magistrate likely to make him/her incompatible, but will have to be accompanied by concrete circumstantial elements of his/her incompatibility.

Articolul pune în discuţie cazul special al unei eventuale incompatibilităţi a judecătorului în cauzele în care una dintre părţi este reprezentată de avocatul care îl reprezintă chiar pe judecător în alte cauze. După analiza reglementărilor specifice dar și a jurisprudenţei naţionale și europene autorul consideră că reprezentarea judecătorului în alte cauze de către avocatul uneia dintre părţi nu este de natură, prin ea însăși, să justifi ce în mod rezonabil temerea cu privire la o prejudecată din partea magistratului de natură să îl facă incompatibil, ci va trebui acompaniată de elemente de circumstanţiere concretă a incompatibilităţii sale.
