Aspecte procesuale referitoare la cererile în justiţie în raportul dintre profesioniști și consumatori

The relations between the producer and the consumer regarding the sale of consumer products may lead to disputes that can be settled by the parties amicably, extrajudicially, or, if this is not possible, by the first instance courts or arbitral courts, which means the observance of each party’s rights and obligations, in accordance with the legal provisions. We consider it useful to analyze in this study the possible types of civil litigation that may arise in the development of these relations, the jurisdiction of the courts, how third parties can intervene in the process between the consumer and the professional.

Derularea raporturilor dintre producător și consumator în ceea ce privește vânzarea produselor destinate consumului pot să conducă la apariţia unor litigii care pot fi soluţionate de către părţi pe cale amiabilă, extrajudiciar, sau în cazul în care acest lucru nu este posibil, de către instanţele judecătorești de drept comun ori arbitrare, obţinându-se astfel respectarea drepturilor și obligaţiilor fiecărei părţi, conform dispoziţiilor legale. Socotim util a analiza în cadrul acestui studiu posibilele tipuri de litigii civile care pot să apară în derularea acestor raporturi, competenţa instanţelor, formele în care terţe persoane pot interveni în cadrul procesului dintre consumator și profesionist.
