Opinii critice referitoare la regimul juridic al operelor orfane în reglementarea Legii nr. 8/1996 privind dreptul de autor și drepturile conexe

Following the completion in 2015 of Law no. 8/1996 on copyright and neighboring rights, as a matter of absolute novelty, regulates the legal regime of „orphan works”.

Reaction of the doctrine of legal protection of intellectual creation to this novelty legal institution is still timid, and the case law seems to have not yet faced litigation in this matter.

The analysis of the established regulations denotes the existence of a relatively large number of insufficiently legal norms, with a real potential to determine different interpretations and, obviously, non-unitary doctrinal or jurisprudential solutions.

Mainly, these are the reasons that have prompted us to try a thorough, systematic and systemic analysis, as well as critically criticizing the legal status of orphan works, being convinced that we will contribute to improving it.

Urmare unor completări aduse, în anul 2015, Legii nr. 8/1996 privind dreptul de autor și drepturile conexe, cu titlu de noutate absolută în sistemul de drept român, este reglementat regimul juridic al „operelor orfane”.

Reacţiile doctrinei din domeniul protecţiei juridice a creaţiei intelectuale la această inedită instituţie juridică sunt încă timide, iar jurisprudenţa, se pare, nu s-a confruntat încă cu litigii din această materie.

Analiza reglementărilor ce-i sunt consacrate denotă existenţa unui număr relativ însemnat de norme insuficient prelucrate juridic, cu potenţial real de a determina interpretări diverse și, evident, soluţii doctrinare sau jurisprudenţiale neunitare.

În principal, acestea sunt motivele care ne-au îndemnat să încercăm o analiză aprofundată, sistematică și sistemică, precum și, de regulă, critică a regimului juridic consacrat operelor orfane, fiind convinși că, astfel, vom contribui la îmbunătăţirea acestuia.
