Incompatibilitatea căii de atac a apelului cu materia contenciosului administrativ

Law no. 554/2004 on administrative litigation, which specificaly regulates this
matter, is supplemented where it does not have provisions derogating from the common law with the civil procedural law (art. 28 of Law no. 554/2004). From the perspective of the appeal that is fi led in the matter of administrative litigation, art. 20 of Law no. 554/2004 expressly provides for the appeal remedy, but this text of the law is interpreted in conjunction with the legal provisions relating to the appeal of the Code of Civil Procedure.

In the unitary interpretation and application of the legal provisions on the appeal in the field of administrative litigation, only the appeal of the appeal may be exercised against the decisions rendered in this matter, except for the case provided by the provisions of art. 25 para. (3) of the Law on Administrative Litigation no. 554/2004, with subsequent amendments and completions.

Legea nr. 554/2004 a contenciosului administrativ, care reglementează în mod special în această materie, se completează acolo unde nu are dispoziţii derogatorii de la dreptul comun cu legea procedurală civilă (art. 28 din Legea nr. 554/2004).

Din perspectiva căii de atac care se formulează în materia contenciosului administrativ, art. 20 din Legea nr. 554/2004 prevede expres calea de atac a recursului însă acest text de lege se interpretează coroborat cu dispoziţiile legale relative la recurs din Codul de procedură civilă. În interpretarea și aplicarea unitară a dispoziţiilor legale privind calea de atac în materia contenciosului administrativ, împotriva hotărârilor pronunţate în această materie poate fi exercitată numai calea de atac a recursului, cu excepţia cazului prevăzut de dispoziţiile art. 25 alin. (3) din Legea contenciosului administrativ nr. 554/2004, cu modifi cările și completările ulterioare.
