Noile reglementări privind constituirea și funcţionarea comisiilor paritare și încheierea acordurilor colective în cadrul autorităţilor și instituţiilor publice – perspectivă critică

The representation of the interests of employees within the framework of legal employment relations also has a correspondent in the field of organized special relations, in connection with the provision of work, at the level of state authorities, respectively for the labour relations of different categories of civil servants, with general statutes or with special statutes or with specific functions. This concept is adapted to the specifics of the organizational framework at the level of which it takes shape, the employees being civil servants who associate, under the law, in trade union organizations so that their interests will be represented or, in their absence, they choose their direct representatives in the relations with the institutional management, the employer being different bodies of the public administration, respectively the leaders of the public authorities and institutions.

Consequently, the other components, related to the fundamental right to work, namely collective bargaining and consultation of employees, must find their corresponding institutions and legal norms, which contribute to the effective provision of the guarantees offered by the constitutional and legal framework in force to particular categories of employees, from the public sector, who are part of the legal office relations.

In order to achieve this objective, specific mechanisms and procedures have been established in the field of social dialogue and at the level of public authorities and institutions where the various categories of civil servants carry out their professional activity, whose functionality and adaptation to the new social and administrative realities must be ensured through an appropriate legal framework.

Reprezentarea intereselor salariaţilor în cadrul raporturilor juridice de muncă are un corespondent și în domeniul raporturilor speciale organizate, în legătură cu prestarea muncii, la nivelul autorităţilor de stat, respectiv pentru raporturile de serviciu ale diferitelor categorii de funcţionari publici, cu statut general sau cu statute speciale ori cu funcţii specifi ce. Acest concept apare adaptat la specificul cadrului organizaţional la nivelul căruia se conturează, în rolul salariaţilor fiind funcţionarii publici, care se asociază, în condiţiile legii, în organizaţii sindicale pentru a le fi reprezentate interesele sau, în lipsa acestora, își aleg reprezentanţi direcţi în relaţiile cu managementul instituţional, iar cel al angajatorului revenind diferitelor organe ale administraţiei publice, respectiv conducătorilor autorităţilor și instituţiilor publice.

În consecinţă, celelalte componente, conexe dreptului fundamental la muncă, respectiv negocierea colectivă și consultarea salariaţilor, trebuie să își regăsească instituţii și norme juridice corespondente, care să concure la asigurarea eficientă a garanţiilor oferite de cadrul constituţional și legal în vigoare și pentru categoriile particulare de salariaţi, din sectorul public, care sunt parte a raporturilor juridice de serviciu.

Pentru realizarea acestui deziderat, au fost instituite mecanisme și proceduri specifice domeniului dialogului social și la nivelul autorităţilor și instituţiilor publice unde își desfășoară activitatea profesională diferitele categorii de funcţionari publici, a căror funcţionalitate și adaptare la noile realităţi sociale și administrative trebuie să fi e asigurate printr-un cadru juridic corespunzător.
